Patent Law in the Global Economic Competition

The marketplace for goods and ideas is international, but the standards for patentability differ, as well as how patent disputes over the validity, infringement, injunctive relief, and damages are resolved by judges from country to country. Although the U.S. and Russia are signatories to the Patent Law Treaty and the Treaty Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS) that have assisted private inventors and corporations in acquiring worldwide patent rights, these conventions have not directly address enforcement internationally in an efficient way.
While respecting national law and intellectual property rights, how can our legal regimes facilitate rather than frustrate global markets? This question will be discussed by members of the U. S. and Russian patent judiciary, the former Undersecretary of Commerce and Director of the U.S.
Patent and Trademark Office and current and former General and Corporate Counsel of IBM Corporation, Johnson & Johnson Company, and Pepsico, all of which have substantial market interests in Russia.
In addition, a few years ago, Chief Judge Randall Rader of the The United States Court of Appeals for the Federal Circuit, that has exclusive jurisdiction over all patent appeals in the U.S., initiated an effort to travel with fellow U.S. judges, the Director of the USPTO, leading members of the U.S. patent bar, and important U.S. corporate patent counsel to meet with their counterparts in China, Japan, and Korea. Similar efforts have been undertaken in the United Kingdom and Germany. A visit to Russia is being planned for 2014-15. The panel will exchange share ideas about the topics that have been of interest in the other countries and are interested in discussing with the audience what the objective of the upcoming visit to Russia should be for both the U.S. and Russian participants.
